These things take time, Rome wasn't built in a day you know.

Fab pics merseywail. I would say, 'keep 'em coming', if you can acknowledge the source. If not then just put 'source unknown'.

    Not a good idea, Kev.
If you know who the photo belongs to, get permission.
If you don't know who to ask, then don't use it.

I disagree Phil. If we all did that, then half of the photo's around the world would never see the light of day. Perhaps adding a 'Source Unknown' and then additional information (or Kev, have something for the whole site).

I have done this on many a photo on various websites and use the following:

"Except where an author or owner is named or an item is in the public domain or its provenance has been impossible to ascertain, this web site and material contained in this web site are copyright of.......

Written permission from ...... must be obtained prior to public use or public redistribution of material from this site or of any material which is copyright.
    All rights reserved."

It basically means that if you cannot find the original source of the photo, you are displaying it until the original owner comes along and asks for credit or removal of the picture.

You're entitled to disagree, but I don't want Kev to get sued.

    I repeat.
Ask permission if you know who owns the photo.
If you don't know who owns it, don't use it, because somebody will own the copyright.

    Otherwise, it's theft.
I know I've made at least one person not like me by stating this before.
But if something isn't yours you can't give it to somebody else.

Even if it's a fabulous photo.
If it's on the net post a link to it.

Kev isn't going to get sued at all Phil. I cannot imagine anyone bringing a copyright case to a forum owner, if that was the case then all forum's around the world would shut down!

It's a very grey subject of which I have taken legal advice on myself (for the same situation). I have been told that as long as I display a legal notice (see above) then I am asking the copyright holder to either inform me not to show the picture or to ask for credit. It's as simple as that and I will take the word over a paid solicitor over yourself.

Jona, let Kev decide what to do.

And don't drag this discussion on any more.
    PLEASE!

    Well, what an eventful day!
Glad that someone remembers the Hall Road tap. Hope that Merseywail is not going, I did not think that some of his pics existed of places!
The copyright issue is interesting, with a very rare exception, I am the copyright holder of what you see.

    Some industrial firms had their own railway shunting locomotives, not usually able to be photographed, here are a few;

    L. Rifkins scrapyard at Kirkdale, July 1976
    Reads at Aintree, September 1976
    Cadbury's at Moreton, September 1976
No. 3, Kirkby Trading Estate, January 1973
Monty, Cronton Colliery, Cronton, May 1972

Phil, I am. I'm just giving my reasons for doing so having been through exactly the same situation on a past website. I consulted a solicitor who was experienced in this matter and I have passed the information on to Kev.

I'm not carrying on the thread 'just because', I'm giving free legal advice which I had to pay a small fortune for.
