    thats great, now what can you do if you find your work in a book or site that is being sold, can you stop it?, get a cut/ or is there a mad process to prove who took the pic,/ after all if you are a pro photographer its your livliehood( there is no copyright on my spellings )

    I personally don't care if anyone takes any of my pictures from my websites. Pictures are there to be displayed for all to see, there is little good in protecting a picture and no one seeing it 'just so no one takes a copy of it'.

    My only objection is if someone is using my pictures and either gaining money or claiming it is their work - if credit is given they can tattoo the picture on their arse for all I care.

    The very first pic shown on this thread - the night one of the Abbey is a Stewart Bale photograph and it's actually on display at the moment as part of their exhibition at the Conservation centre.

    I have emailed Knowhowe and offerd to send the CD called Images of Old Liverpool to him to check if there are any more of his on it.
    I have also sent the correspondence I am currently having with Ebay over the seller as it was probably about 2 years ago I bought the CD.
    The seller is ( or was ) making money out of it as I paid for it, maybe £10.
    I will hold off posting anymore until I hear from knowhowe and ebay. Martin

    Short answer.
    Sue them.

    If they're charging for somebody else's photos, then they'll be tracable.

    Of course, if they're not making a profit, and are "sharing" photos (which don't belong to them), obviously it then clouds the issue, and makes it difficult to find out who they are.

    If I'm asked in advance, (and it's not for profit), I always give permission, and then get a buzz when I see my name.

    is there a track record of lawsuits, and if so what is the outcome, damages or just pride and a lawyers bill ?

    There was a thread about this, ages ago, and the general opinion was that most cases were settled out of court, usually in the original photograher's favour.

    This could be the way I'm going to "watermark" my photos.
    This is a postcard, and I can't claim copyright, but it's age (about 100 years) would make it difficult to find out if any copyright is still valid.
    After collecting postcards for about 40 years, I know that this image is extremely rare (and subsequently I paid quite a lot for it.)

    but does having paid money for something give you copyright, i realise your genuine but that would not stand up in a legal argument

    In the days of film the photographer would have the negatives.
    I've still got all my old negatives.

    Now, the date and time is recorded on digital photos, and the thing is to keep some photos private, so you can prove that the published one was one of the original set.

    No it doesn't.
    That's why I said the postcard is from my collection.
    Copyright is a legal thing, but it can be bought or transferred.

    it's all a very grey area, it's just in the past few months i've seen some fantastic photos on this site from some great photographers and always wondered if someone stole something would you get anything back
