    Fair Use -- United States Fair Dealing - Commonwealth of Nations
    The "fair use" provision of U.S. copyright law contains a list of the various purposes for which the reproduction of a particular work may be considered ?fair,? such as criticism, comment, news reporting, teaching, scholarship, and research. The four factors to be considered in determining whether or not a particular use is fair:
    The purpose and character of the use.
    The nature of the copyrighted work.
    The amount and substantiality of the portion used in relation to the copyrighted work as a whole.
    The effect of the use upon the potential market for or value of the copyrighted work.
    U.S. Copyright Office statement of fair use.

    Fair dealing is a doctrine of limitations and exceptions to copyright which is found in many of the common law jurisdictions of the Commonwealth of Nations, including Canada, Australia, New Zealand, Singapore, United Kingdom, and South Africa. The possible defenses in Canada include:

    The purpose of the dealing.
    The character of the dealing.
    The amount of the dealing.
    Alternatives to the dealing.
    The nature of the work.
    Effect of the dealing on the work.


    Canadian Intellectual Property Office statement on fair dealing.


    The safest course is always to get permission from the copyright owner before using copyrighted material.

    The distinction between ?fair use? and infringement may be unclear and not easily defined. There is no specific number of words, lines, or notes that may safely be taken without permission. Acknowledging the source of the copyrighted material does not substitute for obtaining permission.

    When it is impracticable to obtain permission, use of copyrighted material should be avoided unless the doctrine of ?fair use? would clearly apply to the situation.

    If it's there to be copied and used then copy and use it. Any problems with that then don't post stuff you don't want copying.
    If it is there to be used then use it I say.
    I am all for protection of the "artists" work and do believe that there should be laws for infringement of copyright especially when it comes to Visual and audio entertainment. But I gotta say........
    (put my fast running shoes on here).............
    People who take pics or post pics on forums etc and include a copyright logo are either wanting to show their pics off and feel that they are themselves important to society. Or they just want to feel important and so proffessional.
    Sad thing is the logos are easy to remove no matter what and if you're good in photoshop you could even change the pic and make it your own.
    Copyright is important in some respects but to us "ordinary folk" it means sod all.

    Sky set top box cheat jailed
    by David Allen



    Keith Cairns has become the first person in the UK to be prosecuted for using illegal equipment to access the BSkyB network.

    The father of four has been selling set top boxes that had been converted so that they would allow the user to access all of the channels available on the Sky satellite TV network, a service that they paid Mr Cairns a monthly subscription fee for.

    He was caught by a BSkyB investigator who noticed his stall at the Bowlers Computer Market at Trafford Park in Manchester.

    This was followed up with officials from the Federation Against Copyright Theft (FACT) raided Mr Cairns home in Liverpool last year.

    During the raid, they seized four set top boxes, a computer and emails from potential customers.

    He was jailed for four months.

    Couldn't agree more Zap. Be nice if folk were still paying me for my plumbing work I done. I done it, I got paid for it, end of it.
